During the food safety raids, 43 restaurants were closed in Kerala

The Food Safety department has decided to step up its inspections across all districts in the wake of yet another fatality in Kottayam that was purportedly brought on by food poisoning.

The Food Safety wing has been asked to tighten regulatory checks and take strict action against those operating food businesses without the mandatory license and those who are running food businesses without adhering to the mandatory food safety and hygiene standards in light of the sporadic reports of food poisoning from many districts following the lull of the holiday season.

Veena George, the minister of health, has ordered the food safety division to take strict action against individuals who serve tainted or contaminated food and those seen to be preparing food in an unsanitary or unhygienic atmosphere.

Selling tainted food or food cooked in an unclean way is a crime, and violating food establishments risks losing their license. According to a statement released by the Health Department on Tuesday, the authorities would make sure that a license that has been revoked cannot be reinstated.

According to the Health Department, all food business owners and individuals who directly handle food preparation should exercise extreme caution in their duties and ensure public health is not jeopardized because contaminated food can negatively impact people’s lives and health.

It is the responsibility of the Food Safety wing to make sure that all food enterprises are functioning under the necessary licenses and registrations and that each public complaint is thoroughly investigated.

An official statement noted that the department’s portal, via which the public can file a complaint online and attach video or photographic evidence, is now being prepared.

Food Safety officials examined four hundred twenty-nine food establishments throughout the State on Tuesday as part of a special push by the department. Forty-three restaurants received notices to close, of which 21 lacked the necessary license, and 22 were discovered to be cooking food in unsanitary conditions. One hundred thirty-eight outlets received improvement notices from the department as well.

From all districts, 44 food samples were gathered from various outlets and sent for analysis.

Food and drinks that are readily available, not produced in a restaurant, and sold over the counter are supplied of products subject to GST and do not meet the definition of “restaurant services,” according to the Gujarat Authority of Advance Ruling (AAR).

The decision of the Appellate Authority of Advance Ruling, Uttrakhand, in the case of M/s Kundan Mishthan, stated that sales of sweets, namkeens, cold drinks, and other edible items from sweet shop counters will be treated as supplies of goods with applicable GST rates of the items being sold, and input credit will be allowed on supplies, was cited by the two-member bench made up of Amit Kumar Mishra and Milind Kavatkar.

The applicant is in the restaurant industry, which provides a range of food items, including food and beverages cooked inside the restaurant as well as easily accessible food and beverages served over the counter. The applicants are independent eateries that solely offer food and drinks; they are not hotels.

The applicant has stated that there are a common billing counter, software, and books of account for all the orders. For the readily available food and beverages sold over the counter and the food and beverages cooked in the restaurant, there is no distinct billing system.

The applicant requested an early decision on the question of whether immediately available food and beverages (not made in the restaurant) sold over the counter by the applicant to the customer, whether consumed in the restaurant or by means of takeout, constitute “restaurant services.”

The AAR has determined that the readily available food items (not those prepared or cooked in the restaurant) that are sold over the counter by the applicant to the customer, whether consumed in the restaurant or by way of takeaway, do not qualify as “restaurant services” but rather fall under the category of “supply of goods,” which is subject to the applicable rate of GST.

HC orders the Delhi Govt to provide free food and medical care to HIV+ people living below the poverty line

The Delhi Government has been ordered by the Delhi High Court to give free food and medical care to HIV-positive people who reside in the nation’s capital and are below the poverty level yet cannot pay it.

The Delhi administration was also told to maintain strict adherence to the Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome (Prevention & Control) Act 2017 and the Rules made thereunder by a division bench led by Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad.

The court issued the instruction while deciding a public interest lawsuit brought in 2011 by a number of people seeking accommodation and other amenities for their well-being, including hot cooked meals, and who were also dealing with multiple infirmities and HIV/AIDS.

The PIL had also asked for guidance on how the Center could quickly decide on all necessary national and state-level policies and programs for food security, permanent housing, and shelter for all such patients.

The National AIDS Control Program has been operating in the nation’s capital since 1998 with the technical and financial assistance of the National AIDS Control Organization, according to the Delhi Government’s statement, which was noted by the court.

According to a most recent affidavit submitted by the Delhi Government on December 19, 2022, numerous rehabilitation programs and procedures are being implemented to help patients who are HIV positive.

The Delhi Government’s “Travel concession scheme for PLHIVS/CLHIVs for People/Children infected with HIV visiting the ART centers in Delhi for undertaking visits to the ART centers” program has 120 beneficiaries enrolled, and 429 applications are now being processed, the court added.

For one year, Dubai will defer the 30% municipal tax on alcoholic beverages

From January 1, 2023, to December 1, 2023, Dubai Municipality will not be collecting the 30% municipality tax on alcoholic beverages.

In response to an online user’s question, the municipality made this information available via its official Twitter account, @DMunicipality.

The Dubai Municipality posted a tweet that said: “Please take note that the 30% tax received by the Dubai Municipality from alcoholic beverage producers has been temporarily halted for one year, beginning on January 1 and ending on December 31, 2023. All businesses with permits to sell alcohol in Dubai have been informed of this choice to take the appropriate action.”

What is the municipality tax of 30%?

The tax levied by the Dubai government is known as the municipality tax. Consumption taxes on products and services include value-added tax (VAT). According to Tyrone Reid, Group CEO of Maritime and Mercantile International (MMI) & Emirates Leisure Retail, the 30% municipality tax on alcoholic beverages has been eliminated, but the 5% VAT is still in effect.

African+Eastern also affirmed that the final price of alcoholic beverages will no longer contain the 30% municipality tax but will instead still include the 5% VAT.

What kinds of taxes are imposed?

In addition to VAT, often referred to as a goods and services tax (GST) in some other nations, and corporate tax on oil firms and foreign banks, the UAE imposes excise tax, also referred to as a “sin tax,” on energy drinks and cigarette products.

Excise taxes have been imposed since December 2019 on a number of products that are often bad for the environment or human health. This includes a 50% tax on carbonated beverages, a 100% tax on tobacco products, energy drinks, electronic smoking devices, and liquids used in such devices and instruments, and a 50% tax on any product with added sugar or other sweeteners.

“Items are subject to sin’ taxes because of their potential for harm or perceived expense to society. Sin taxes aim to discourage people from engaging in actions and behaviours that are bad for society. Municipal taxes, on the other hand, are more of a local tax that the government imposes for certain services, according to Dixit Jain, managing director of The Tax Experts DMCC, a Dubai-based tax advisory firm.

“So, for the people to understand, the municipal tax will be eliminated, which will save some money out of their pockets, but at the same time VAT will be charged when they buy, which is applied at a rate of 5%,”

License cost for alcohol eliminated

Retailers claim that alcohol license fees have also been eliminated in Dubai as a result of government regulations.

“We are implementing the Government of Dubai’s orders, therefore all people entitled to legally purchase alcoholic beverages in Dubai can apply for a personal liquor permit at… our… stores in Dubai, now free of charge,” Reid added.

How to submit a liquor license application in Dubai

Although a personal alcohol permit is still required to buy, consume, transport, or keep alcohol at home, according to updates from MMI and African+Eastern, the license charge has been eliminated in Dubai.

You only need to visit an MMI or African+Eastern store with one of your identity documents, such as an Emirates ID if you are a resident or a passport if you are a visitor, to obtain an alcohol license.

Rules to remember

Alcohol can only be drunk privately or in public locations that have a license if you are at least 21 years old.
